MorphoSource Download Use Agreement

Each time a user downloads one or more Media from MorphoSource, they must agree to a standardized download use agreement. This agreement describes terms of use and re-use of data downloaded from MorphoSource that the downloading user is expected to comply with. Data contributors can select between two main versions of the agreement, and customize specific statements in the agreement. The agreement makes no reference to copyright status of media and is independent of whether media are considered copyrighted or not. Copyright and Licensing and Additional Usage Agreement features can also be used to restrict use and re-use of media, complementing the use agreement described here.

Use Agreement Types

This drop-down field allows data contributors to choose between permissive (documentation | full agreement) and standard (documentation | full agreement) versions of the use agreement. The permissive version of the agreement is a standalone set of expectations that should be used if a data contributor would like to allow their media to be more freely used and reused. The standard version of the agreement entails all of the expectations of the permissive agreement as well as additional expectations and restrictions, and data contributors can further customize specific expectations in the standard agreement, as explained below. The text common to both agreements can be found here and is identical to the full permissive agreement.

Can the Use Agreement be disabled? No. The MorphoSource interface enforces compatibility between settings of copyright statements, CC licenses, and use agreement settings where there is explicit overlap. However, the standard use agreement has use and re-use provisions that are not mentioned in any CC licenses. Thus, contributors should review the custom settings of the use agreement associated with their media even if they plan to rely on other aspects of Ownership and Permissions settings to regulate use and re-use.
